The terms “you” and “your” refer to the user of the Platform. The term “Services” refers to any services offered by BroomBoom Cabs/You whether on the BroomBoom Cabs Platform or otherwise. Please read this Policy before using the BroomBoom Cabs Platform or submitting any personal information to BroomBoom Cabs. This Policy is a part of and incorporated within, and is to be read along with, the applicable Terms and Conditions based on the user of the BroomBoom Cabs Platform. By using the BroomBoom Cabs Platform and the Services, you agree and consent to the collection, transfer, use, storage, disclosure, and sharing of your information as described and collected by us by this Policy. If you do not agree with the Policy, please do not use or access the BroomBoom Cabs Platform. DEFINITIONS

Unless otherwise provided in this Privacy Policy, the terms capitalized in the Privacy Policy shall have the meaning as provided hereunder: “Pilots” means independent third-party vehicle operators or riders who wish to offer services on the BroomBoom Cabs Platform to a User. “Co-branded Services” shall have the meaning assigned to the term in paragraph 4(c) hereto. “Customer” shall mean a person who wishes to receive the services of the Pilots on the BroomBoom Cabs Platform. “Device” shall mean computer, mobile, or other device used to access the Services. “Device Identifier” shall mean the IP address or another unique identifier for the Device. “Mobile Application” shall mean an application provided by us on the Device to access the Services. “Mobile Device Information” shall have the meaning assigned to the term in paragraph 2(II)(e)(ii) hereto. “Promotion” shall mean any contest and other promotions offered by us. “Protected Information” shall mean such categories of information that could reasonably be used to identify you personally, including your name, e-mail address, location, and mobile number. “Third Party” shall mean a third-party service provider. “Usage Information” shall have the meaning assigned to the term in paragraph 2(II)(a) hereto.

WHAT INFORMATION DO WE COLLECT?

INFORMATION YOU PROVIDE TO US We may ask you to provide us with certain Protected Information. We may collect this information through various means and in various places through the Services, including account registration forms, contact us forms, or when you otherwise interact with us. When you sign up to use the Services, you create a user profile. We shall ask you to provide only such Protected Information which is for a lawful purpose connected with our Services and necessary to be collected by us for such purpose. Information you give us – This includes information submitted when You: Create or update the BroomBoom Cabs account which may include your Email ID, Name, Address, Mobile Number, Gender, Date of birth, Login Name, and Password. Use Our Services, we may collect and store information about you to process your requests and automatically complete forms for future transactions, including (but not limited to) your phone number, address, email, billing information, etc. Correspond with BroomBoom Cabs for customer support. Report problems for troubleshooting. If you sign up to use our Services as a vendor or Pilots, we may collect location details, profile picture, copies of government identification documents and other details (KYC), vehicle-related documents such as insurance, pollution certificate, etc and such other documents which evidence the health or fitness of the vehicle to provide Services on the BroomBoom Cabs Platform, call and SMS details. We collect background checks and identity verification information of the Pilots. This may include information such as driver’s history or criminal record (where permitted by law), and right to work. This information may be collected by an authorized vendor on the Company’s behalf. In case you sign up as a Pilot, enable features that require BroomBoom Cabs’s access to other applications on Your Device aiming to prevent fraud towards the Customers. If you sign up to use our Services as an employee or as a stakeholder of a third party to whom the Company has an arrangement and has offered discount coupons/ or extended certain promotional offers, the Company may share any information provided by you with such third party to be utilized by them for limited internal business purposes only.

INFORMATION WE COLLECT AS YOU ACCESS AND USE OUR SERVICES

In addition to any Protected Information or other information that you choose to submit to us, we and our third-party service provider may use a variety of technologies that automatically (or passively) collect certain information whenever you visit or interact with the Services (“Usage Information”). This Usage Information may include the browser that you are using, the URL that referred you to our Services, all of the areas within our Services that you visit, and the time of day, among other information. In addition, we collect your Device Identifier for your Device. Location data: Pilots:broomboomcabs collects location data when the broomboomcabs App is running in the foreground (the app is open and on-screen) or background (the app is not in use) of their mobile device. broomboomcabs collects location data only when the Pilots have enabled the icon “On-Duty” on the broomboomcabs App. Customers: We collect precise or approximate location data from the users’ mobile devices if they enable us to do so. broomboomcabs Pilot App collects this data from the time a ride is requested until it is finished, and any time the app is running in the foreground of their mobile device. We use this data to enhance your use of our apps, including to improve pick-up locations, enable safety features, and prevent and detect fraud. broomboomcabs Pilot App collects the Pilots’ location data, and links location data collected during a trip with their customer’s account, even if the Customer has not enabled us to collect location data from their device. This enables us to offer services to the Customers like receipt generation and customer support. Information Third Parties provide about You: We may, from time to time, supplement the information we collect about you through our website or Mobile Application or Services with outside records from third parties.

Information Third Parties Provide About You: We may, from time to time, supplement the information we collect about you through our website or Mobile Application or Services with outside records from third parties.
Device data: We may collect data about the devices used to access our services, including the hardware models, device IP address or other unique device identifiers, operating systems and versions, software, preferred languages, advertising identifiers, device motion data, and mobile network data. Communications data: We enable users to communicate with each other through BroomBoom Cabs mobile app and websites. For example, we enable drivers and riders to call, text, or send other files to each other (generally without disclosing their telephone numbers to each other). To provide this service, BroomBoom Cabs receives some data regarding calls, texts, or other communications, including the date and time of the communications and the content of the communications. BroomBoom Cabs may also use this data for customer support services (including resolving disputes between users), for safety and security purposes, to improve our services and features, and for analytics. Safety recordings: In certain jurisdictions, and permitted by law, users get an option where they can record the audio and/or video of their trips through an in-app feature or using a dashcam. In the BroomBoom Cabs App, recordings are encrypted and stored in Company’s data and are only shared if submitted to customer support by the users in connection with safety incidents.
How does broomboomcabs use contacts?
The BroomBoom Cabs app will support connecting your phone’s contacts to your account. This feature allowed the BroomBoom Cabs app to make personalized recommendations for you (such as suggesting which friends to invite). The contacts from your phone will sync to BroomBoom Cabs servers. The app will continue to ask for the contact's permission if you use features that display your address book within the app, for example:

How broomboomcabs uses rider location information (Android)?

You’ll see a request prompted by your device for permission to share your location information when you sign up for BroomBoom Cabs, which includes location data collected via Bluetooth and nearby Wi-Fi signals. As a default, for the best service available the app asks you to turn on location services “Allow only while using the app.” We use location data to find drivers that are near you and help them navigate to your pickup spot. We also use it to display trip history in your receipts, to understand and resolve support tickets, and to troubleshoot and solve software bugs.

If you’re using an Android device, you have 3 location settings to choose from: Allow all the time: We may collect location information at any time, even when you’re not actively using the BroomBoom Cabs App. If a service needs “Allow all the time” we’ll ask for your permission when you enable the service.
Deny: This option disables location services for the BroomBoom Cabs app. You can still use the app, but you’ll need to enter your pickup and drop-off locations manually. Location information will be collected from the driver during your trip and linked to your account, even if you have disabled location services for your app.

In some instances, we’re required to share information about the trips taken on our service with cities, governments, and local transportation authorities.
To meet these requirements, we collect geolocation and timestamp data from the devices, bikes, and scooters on our platform.
This data provides cities with information on where each trip starts, stops, and the route taken on the trip. None of the trip data we provide to cities is collected from your personal mobile device or directly identifies you.
Depending on how you use the BroomBoom Cabs platform, the contents of your data download may include the following.

Referral code(s) issued by BroomBoom Cabs

Metadata about support conversations with BroomBoom Cabs
Names and addresses of places you’ve saved
Rider data

Your rider data includes information used to get you to your destination, such as:
Times and locations at which a trip was requested, started, and ended, as well as distance traveled

Enable transportation and drop-off services (such as using location data to facilitate a rider or pickup or drop-off), features that involve data sharing (such as fare splitting, ETA sharing, and ratings and compliments), and accessibility features to facilitate use of our services by those with disabilities

Process payments.

Track and share the progress of rides

Create broomboomcabs travel itineraries and offer related services, such as rides to the rental car reservations, or etc.

Facilitate insurance, vehicle, invoicing, or financing solutions

Perform necessary operations to maintain our services, including troubleshooting software bugs and operational problems, conducting data analysis, testing, and research, and monitoring and analyse usage and activity trends.
BroomBoom Cabs performs the above activities, including the collection and use of location data for purposes of these activities, on the grounds that they are necessary to fulfil our obligations to users under our Terms of Use or other agreements with users.
2.Safety and security: We use personal data to help maintain the safety, security, and integrity of our services and users. This includes:

Verifying users’ identity and eligibility to provide transportationincluding through reviews of background checks, where permitted by law, to help prevent use of our services by unsafe drivers and/or riders.

Using data from drivers’ devices to detect unsafe driving behaviour such as speeding or harsh braking and acceleration, and to inform them of safer driving practices.

Using device, location, user profile, usage, and other data to prevent, detect, and combat fraud. This includes identifying fraudulent accounts or uses of our services, preventing use of our services by unauthorized drivers, verifying user identities in connection with certain payment methods, and preventing and combating unauthorized access to users’ accounts.

Using user ratings, reported incidents, and other feedback to encourage compliance with our Community Guidelines and as grounds for deactivating users with low ratings or who otherwise violated such guidelines in certain countries. Using ratings, usage and other data to prevent matching of riders and drivers for whom there is higher risk of conflict (for instance, because one user previously gave the other a one-star rating).
Sharing user name, location, phone number, vehicle details and other relevant information with third-party companies that support the management and de-escalation of interpersonal conflicts that may occur between users while on a trip.

broomboomcabs performs the above activities on the grounds that they are necessary to fulfil our obligations to users under our Terms of Use or other agreements with users, and/or for purposes of the legitimate safety and security interests of broomboomcabs or other parties, including users and members of the general public.

3.Customer support: BroomBoom Cabs uses the information we collect (which may include call recordings) to provide customer support, including to investigate and address user concerns and to monitor and improve our customer support responses and processes.
BroomBoom Cabs performs the above activities on the grounds that they are necessary to fulfil our obligations to users under our Terms of Use or other agreements with users.
4.Research and development:
We may use personal data for testing, research, analysis, product development, and machine learning to improve the user experience. This helps us make our services more convenient and easier-to-use, enhance the safety and security of our services, and develop new services and features. 5.Enabling communications between users: For example, a driver may message or call a rider to confirm a pick-up location, a rider may contact a driver to retrieve a lost item or may call an order recipient with information about their order.
broomboomcabs performs the above activities on the grounds that they are necessary to fulfil our obligations to users under our Terms of Use or other agreements with users.

6.Marketing:
BroomBoom Cabs may use personal data to market our services to our users. This includes sending users communications about BroomBoom Cabs services, features, promotions, sweepstakes, studies, surveys, news, updates, and events. We may do so through various methods, including email, text messages, push notifications, in app communications and ads, and ads on third party platforms.
7. We may also inform users about products and services offered by BroomBoom Cabs For example, we may provide recommendations, promotions, or ads based on users’ past orders. Although we inform users about products and services offered by BroomBoom Cabs we do not sell users’ personal data to, or share it with, such partners or others for purposes of their own direct marketing or advertising, except with users’ consent. 8. We may use the data we collect, including in combination with advertising partners’ data, to personalize and improve the marketing communications (including ads) that we send on and off BroomBoom Cabs App and websites, including based on user location, use of BroomBoom Cabs’s services, and user preferences and settings. For example, we share user data (such as hashed email address, usage information, and device or user identifiers) with Facebook and Instagram to personalize and improve our ads for BroomBoom Cabs’s services.
9.Non-marketing communications: BroomBoom Cabs may use personal data to generate and provide users with receipts; inform them of changes to our terms, services, or policies; or send other communications that aren’t for the purpose of marketing the services or products of BroomBoom Cabs
BroomBoom Cabs performs the above activities on the grounds that they are necessary to fulfil our obligations to users under our Terms of Use or other agreements with users, or for purposes of BroomBoom Cabs’s and its users’ legitimate interests in informing users about events that may have an impact on how they can use BroomBoom Cabs services.
10.Legal proceedings and requirements:
We may use personal data to investigate or address claims or disputes relating to use of BroomBoom Cabs’s services, to satisfy requirements under applicable laws, regulations, or operating licenses or agreements, or pursuant to legal process or governmental request, including from law enforcement.
BroomBoom Cabs performs the above activities on the grounds that they are necessary for purposes of BroomBoom Cabs’s legitimate interests in investigating and responding to claims and disputes relating to use of BroomBoom Cabs’s services and features, and/or necessary for compliance with applicable legal requirements.

INFORMATION COLLECTED BY MOBILE APPLICATIONS

Our Services are primarily provided through the Mobile Application. We may collect and use technical data and related information, including but not limited to, technical information about your device, system and application software, and peripherals, that is gathered periodically to facilitate the provision of software updates, product support, and other services to you (if any) related to such Mobile Applications. When you use any of our Mobile Applications, the Mobile Application may automatically collect and store some or all of the following information from your mobile device (“Mobile Device Information”), in addition to the Device Information, including without limitation: Your preferred language and country site (if applicable) The manufacturer and model of your mobile device Your mobile operating system The type of mobile internet browsers you are using Your geolocation Information about how you interact with the Mobile Application and any of our websites to which the Mobile Application links, such as how many times you use a specific part of the Mobile Application over a given period, the amount of time you spend using the Mobile Application, how often you use the Mobile Application, actions you take in the Mobile Application and how you engage with the Mobile Application Information to allow us to personalize the services and content available through the Mobile Application Data from SMS/ text messages upon receiving Device permissions for (i) issuing and receiving one-time passwords and other device verification, and (ii) automatically filling verification details during financial transactions, either through us or a third-party service provider, by applicable law. We do not share or transfer SMS/ text message data to any third party other than as provided under this Privacy Policy. If you are a vendor or a Pilot, we will, additionally, record your calls with us made from the device used to provide Services, related call details, SMS details location, and address details.

USE OF INFORMATION COLLECTED

Our primary goal in collecting your information is to provide you with an enhanced experience when using the Services. We use your information to closely monitor which features of the Services are used most, to allow you to view your trip history, and rate trips, and to determine which features we need to focus on improving, including usage patterns and geographic locations to determine where we should offer or focus services, features and/or resources. Based on the Protected Information you provide us when registering for an account, we will send you a welcoming email to verify your username and password. We use the information collected from our Mobile Application so that we can serve you the correct app version depending on your device type, for troubleshooting and in some cases, marketing purposes. We use your Internet Protocol (IP) address to help diagnose problems with our computer server and to administer our website (s). Your IP address is used to help identify you but contains no personal information about you. We will send you strictly service-related announcements on rare occasions when it is necessary to do so. For instance, if our Services are temporarily suspended for maintenance, we might send you an email. If you do not wish to receive them, you have the option to deactivate your account. We may use the information obtained from you to prevent, discover and investigate violations of this Privacy Policy or any applicable terms of service or terms of use for the Mobile Application, and investigate fraud, chargeback, or other matters. We provide some of your Protected Information (such as your name, pick-up address, and contact number) to the Pilot who accepts your request for transportation so that the Pilot may contact and find you. In the case of the Customers, we use the geo-location information for various purposes, including for such Customers to be able to view the Pilots in your area that are close to your location to provide services to You, to automatically fetch your location when you open the BroomBoom Cabs App, for the Pilots to identify the pickup location and to allow you (if you choose through any features we may provide) to share this information with other people for your safety. In the case of the Pilots, we use the geo-location information for (only when the Pilot activates the icon “On-Duty” or logged in on the BroomBoom Cabs App) the Pilots to receive orders close to his location even when the BroomBoom Cabs App is not in use or closed, to enable the Customers to track the distance of the Pilots from their location for pick up, to share the exact location for the safety of the Customers. In addition, we may use your Protected Information or Usage Information that we collect about you: (a) to provide you with information or services or to process transactions that you have requested or agreed to receive including sending you electronic newsletters, or to provide you with special offers or promotional materials on behalf of us or third parties; (b) to enable you to participate in a variety of the Service’s features such as online or mobile entry sweepstakes, contests or other promotions; (c) to contact you about your use of the Services and, in our discretion, changes to the Services and/or the Services’ policies; (d) for internal business purposes; (e) for inclusion in our data analytics; and (f) for purposes disclosed at the time you provide your information or as otherwise outlined in this Privacy Policy. We do not use the information collected from you for targeted advertising.

HOW AND WHEN DO WE DISCLOSE INFORMATION TO THIRD PARTIES

We do not sell, share, rent, or trade the information we have collected about you, other than as disclosed within this Privacy Policy or at the time you provide your information. Following are the situations when information may be shared:

THIRD PARTIES PROVIDING SERVICES ON OUR BEHALF

We use third-party companies and individuals to facilitate our Services, provide or perform certain aspects of the Services on our behalf – such as host the Services, design and/or operate the Services’ features, track the Services’ analytics, process payments, engage in anti-fraud and security measures, provide customer support, provide geo-location information to our drivers, enable us to send you special offers, host our job application form, perform technical services (e.g., without limitation, maintenance services, database management, web analytics and improvement of the Services‘ features), or perform other administrative services. These third parties will have access to user information, including Protected Information to only carry out the services they are performing for you or us. Each of these third parties including is required to ensure the same level of data protection as us and is obligated not to disclose or use Protected Information for any other purpose. Analytics Third Party may set and access their cookies, web beacons, and embedded scripts on your Device, and they may otherwise collect or have access to information about you, including non-personally identifiable information We use a third-party hosting provider who hosts the support section of our website. Information collected within this section of our website by such a third party is governed by our Privacy Policy.

CO-BRANDED SERVICES.

Certain aspects of the Services may be provided to you in association with third parties (“Co-Branded Services”) such as credit houses, loan providers, sponsors, and charities, and may require you to disclose Protected Information to them. Such Co-Branded Services will identify the third party. If you elect to register for products and/or services through the Co-Branded Services, you shall have deemed to consent to provide your information to both us and the third party. Further, if you sign in to a Co-Branded Service with a username and password obtained through our Services, your Protected Information may be disclosed to the identified third parties for that Co-Branded Service and will be subject to their posted privacy policies.

CONTESTS AND PROMOTIONS

We may offer Promotions through the Services that may require registration. By participating in a Promotion, you are agreeing to official rules that govern that Promotion, which may contain specific requirements for you, including, allowing the sponsor of the Promotion to use your name, voice, and/or likeness in advertising or marketing associated with the Promotion. If you choose to enter a Promotion, you agree that your Protected Information may be disclosed to third parties or the public in connection with the administration of such Promotion, including, in connection with winner selection, prize fulfilment, and as required by law or permitted by the Promotion’s official rules, such as on a winners list.

ADMINISTRATIVE AND LEGAL REASONS

We cooperate with government and law enforcement officials and private parties to enforce and comply with the law. Thus, we may access, use, preserve, transfer and disclose your information (including Protected Information, IP address, Device Information, or geo-location data), to Government or law enforcement officials or private parties as we reasonably determine is necessary and appropriate: (i) to satisfy any applicable law, regulation, subpoenas, governmental requests or legal process; (ii) to protect and/or defend the Terms and Conditions for online and mobile Services or other policies applicable to any online and mobile Services, including investigation of potential violations thereof; (iii) to protect the safety, rights, property or security of the Company, our Services or any third party; (iv) to protect the safety of the public for any reason; (v) to detect, prevent or otherwise address fraud, security or technical issues; and /or (vi) to prevent or stop activity we may consider to be or to pose a risk of being, an illegal, unethical, or legally actionable activity.

WHEN YOU SHARE INFORMATION

Protected Information may be collected and shared with third parties if there is content from the Mobile Application that you specifically and knowingly upload to, share with, or transmit to an email recipient, online community, website, or to the public, e.g., uploaded photos, posted reviews or comments, or information about you or your ride that you choose to share with others through features which may be provided on our Services. This uploaded, shared or transmitted content will also be subject to the privacy policy of the email, online community website, social media, or another platform to which you upload, share or transmit the content.

BUSINESS TRANSFER

We may share your information, including your Protected Information and Usage Information with our parent, subsidiaries, and affiliates for internal reasons, including business and operational purposes. SOCIAL MEDIA FEATURES AND WIDGETS

Our online and mobile Services may include social media features, such as the Facebook Like button, widgets such as a “Share This” button, or interactive mini-programs that run on our online and mobile Services. These features may collect your IP address, photograph, which page you are visiting on our online or mobile Services, and may set a cookie to enable the feature to function properly. Social media features and widgets are either hosted by a third party or hosted directly on our online Services. INFORMATION COLLECTED BY PILOTS

This Privacy Policy shall not cover the usage of any information about you which is obtained by the Pilot while providing you a ride on a bike booked using the Services, or otherwise. If you are a Pilot, we may share your name, vehicle number, driving license number, phone number, and/or profile picture (if applicable), and tracking details with our customers to provide them the Services.

INFORMATION YOU PROVIDE TO US

We may ask you to provide us with certain Protected Information. We may collect this information through various means and in various places through the Services, including account registration forms, contact us forms, or when you otherwise interact with us. When you sign up to use the Services, you create a user profile. We shall ask you to provide only such Protected Information which is for lawful purpose connected with our Services and necessary to be collected by us for such purpose. If you feel that you were charged a cancellation fee incorrectly, you can request a Cancellation Fee Waiver, based on your ride case study, the company will decide whether your request will be approved or not.

A cancellation fee is charged to compensate drivers for the time, effort, and fuel spent while trying to reach the pickup location and waiting for the customer.

You may be charged a cancellation fee if any one of the following occurs:

(a) a trip is canceled after 3 (three) minutes or later from the time of acceptance of any rides/pre Schedule rides by the driver

(b) a driver cancels the booking after waiting at your pickup location for 5 minutes or more in any rides.

However, in fully confirmed pre Schedule rides or real time based confirmed rides, 100% cancellation charges are applied on the full amount. No refund or return gets initiated in fully confirmed rides.

• If Ride does not get started within 30 minutes from pickup time after the arrival of the pilot at the pickup location, cancellation charges are imposed on those rides.

The cancellation fee amount may vary depending on your city, and the vehicle category selected.

A cancellation fee, if charged, will be added to the total bill amount of your next or current ongoing BroomBoom rides.

• In certain scenarios, booking once placed and after the ride Confirmation, no advance or mistaken amount gets refunded back, even cancellation and penalty charges will be imposed if anyone finds guilty in doing any unethical activities

CHANGE OF INFORMATION AND CANCELLATION OF ACCOUNT

You are responsible for maintaining the accuracy of the information you submit to us, such as your contact information provided as part of account registration. If your Protected Information changes, or if you no longer desire our Services, you may correct, delete inaccuracies, or amend information by making the change on our member information page or by contacting us through email address mentioned on our website or Mobile Application. We will make good faith efforts to make requested changes in our then-active databases as soon as reasonably practicable. You may also cancel or modify the communications that you have elected to receive from the Services by following the instructions contained within an e-mail or by logging into your user account and changing your communication preferences. If upon modifying or changing the information earlier provided to Us, we find it difficult to permit access to our Services to you due to insufficiency/ inaccuracy of the information, we may, in our sole discretion terminate your access to the Services by providing you a written notice to this effect on your registered email id. If you wish to cancel your account or request that we no longer use your information to provide you services, contact us through the email address mentioned on the trip bill received. We will retain your Protected Information and Usage Information (including geo-location) for as long as your account with the Services is active and as needed to provide you services. Even after your account is terminated, we will retain your Protected Information and Usage Information (including geo-location, trip history, and transaction history) as needed to comply with our legal and regulatory obligations, resolve disputes, conclude any activities related to the cancellation of an account, investigate or prevent fraud and other inappropriate activity, to enforce our agreements, and for other business reason. After some time, your data may be anonymized and aggregated, and then maybe held by us as long as necessary for us to provide our Services effectively, but our use of the anonymized data will be solely for analytic purposes.
